This Privacy Policy describes the policies and procedures of CuraCourse ("the Company," "We," "Us," or "Our") on the collection, use, and disclosure of Your information when You use the CuraCourse platform and services (the "Service"). It informs You about Your privacy rights and how the law protects You. CuraCourse is an educational technology (EdTech) service designed to support learning and educational institutions.

We are committed to protecting the privacy of all our users, especially students. We use Your Personal Data to provide and improve the Service in an educational context. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access our Service or parts of our Service. Accounts may be created by individual users (e.g., educators, parents) or provisioned by an Educational Institution (e.g., for students or teachers).

  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

  • Application refers to CuraCourse, the software program and web platform provided by the Company.

  • Child/Children refers to an individual(s) under the age of 13 in the United States, or under the age required for valid consent in other applicable jurisdictions (e.g., under 16 in certain EU member states).

  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to CuraCourse.

  • Country refers to: United States. Depending on where Our users are located, other relevant privacy laws may apply, including but not limited to the General Data Protection Regulation (GDPR) in the European Union and the UK GDPR in the United Kingdom.

  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

  • Educational Institution refers to a school, school district, university, or other similar educational organization that licenses or uses the Service, typically acting as the data controller for Student Data.

  • FERPA refers to the Family Educational Rights and Privacy Act (20 U.S.C. § 1232g; 34 CFR Part 99), a U.S. federal law that protects the privacy of student education records.

  • Personal Data is any information that relates to an identified or identifiable individual. For students, this includes "Personally Identifiable Information" (PII) under FERPA and COPPA, and "personal data" under GDPR.

  • Service refers to the Application, including any associated websites, APIs, and online services provided by CuraCourse.

  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

  • Student Data refers to Personal Data of students, including education records subject to FERPA, and other personally identifiable information collected by CuraCourse from or about students in the course of providing the Service to an Educational Institution.

  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. For students, "You" may also refer to the student's parent or legal guardian where appropriate.

Collecting and Using Your Personal Data

Types of Data Collected

Personal Data (including Student Data)

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You, or to enable Your use of the Service. When acting as a service provider to an Educational Institution, the collection and use of Student Data is governed by Our agreements with that institution.

Personally identifiable information may include, but is not limited to:

  • Contact Information: Email address, first name and last name, phone number, mailing address.
  • Account Credentials: Usernames and encrypted passwords (for individual users, educators, and administrators).
  • Educational Information (Student Data, when provided by an Educational Institution): Student names, student IDs, grade level, school enrollment information, class enrollments, assignments, grades, performance data, progress data, and any other data that is part of a student's education record as defined by FERPA. We collect this data strictly to provide the educational service for the institution.
  • Educator/Administrator Information: Names, email addresses, roles, and associated Educational Institution information.
  • User-Generated Content: Any content created, uploaded, or shared by You within the Service (e.g., assignments, discussions, projects, feedback), which may contain Personal Data.
  • Billing Information: (For subscription-based services, typically from Educational Institutions or individual educators/parents): Payment method details, billing address (processed securely by third-party payment processors, We do not directly store full payment card details).
  • Usage Data: As described below.

Usage Data

Usage Data is collected automatically when using the Service. This data helps us understand how the Service is being used, identify areas for improvement, and maintain the functionality and security of the platform. We collect Usage Data in a manner that aims to minimize the collection of PII when not essential for the core educational function.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

Tracking Technologies and Cookies

We use Cookies and similar tracking technologies to track the activity on Our Service and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze Our Service. The technologies We use may include:

  • Cookies or Browser Cookies. A cookie is a small file placed on Your Device. You can instruct Your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if You do not accept Cookies, You may not be able to use some parts of our Service. Unless you have adjusted Your browser setting so that it will refuse Cookies, Our Service may use Cookies.

The purpose of these Cookies is to provide You with a more personal experience and to avoid You having to re-enter your preferences every time You use the Website.

    • Administered by: Third-Party Service Providers
    • Purpose: These Cookies allow us to understand how our Service is being used, for example, which pages are visited most often and if users are getting error messages from certain pages. We use this data to improve the functionality and user experience of CuraCourse. For Student Data, such analytics are anonymized or aggregated where possible, and strictly limited to educational purposes under contract with schools.

Role of CuraCourse and Educational Institutions (Data Controllers and Processors)

When CuraCourse is used by an Educational Institution, the institution generally acts as the Data Controller, meaning they determine the purposes and means of processing Student Data. CuraCourse acts as a Data Processor (or "school official" under FERPA) on behalf of and at the direction of the Educational Institution. Our collection, use, and disclosure of Student Data are governed by our contract with the Educational Institution and applicable laws like FERPA, COPPA, and GDPR.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service, including to monitor the usage of our Service, and to ensure its functionality and educational efficacy.
  • To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.
  • For the performance of a contract: the development, compliance and undertaking of the agreement for the services You have purchased or of any other contract with Us through the Service (e.g., with an Educational Institution or individual subscriber).
  • To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.
  • To provide You with support: To provide customer and technical support related to the Service.
  • To personalize the learning experience: To tailor content, features, and recommendations within the Service to individual users, for legitimate educational purposes as directed by the Educational Institution.
  • To improve the Service: For research and development, to understand user needs, troubleshoot, and enhance the functionality, performance, and features of CuraCourse. This may involve using anonymized or aggregated data.
  • To manage Your requests: To attend and manage Your requests to Us.
  • For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred. We will provide specific notice and ensure appropriate safeguards in such cases, especially for Student Data.
  • For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our campaigns and to evaluate and improve our Service, products, marketing and your experience.
  • To comply with legal obligations: To meet legal, regulatory, or contractual obligations, including those related to student privacy (e.g., FERPA, COPPA, GDPR).

Restrictions on Use of Student Data

CuraCourse is committed to protecting Student Data. We will NOT:

  • Use Student Data for targeted advertising purposes.
  • Sell or rent Student Data to third parties.
  • Build profiles of students for non-educational purposes.
  • Disclose Student Data to third parties except as necessary to provide the Service, as authorized by an Educational Institution or parent/guardian, or as required by law.

Sharing Your Personal Data

We may share Your personal information in the following situations:

  • With Educational Institutions: When an Educational Institution contracts with Us, we share relevant Student Data and other user data (e.g., teacher data) with that institution to facilitate the educational services they have requested. The Educational Institution is responsible for managing student data in accordance with their own policies and legal obligations.
  • With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Service, facilitate service delivery (e.g., cloud hosting, email delivery, customer support), or to contact You. These Service Providers are contractually bound to protect the data and use it only for the purposes for which it was disclosed, and in compliance with this Privacy Policy and applicable laws.
  • For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company. We will ensure that any such transfer is subject to appropriate privacy and security safeguards, and provide notice as required by law, particularly for Student Data.
  • With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
  • With business partners: We may share Your information with Our business partners to offer You certain products, services or promotions ONLY with your explicit consent or where such sharing is directly related to the core educational purpose as authorized by an Educational Institution. We do not share Student Data with business partners for marketing purposes.
  • With other users: When You share personal information or otherwise interact in the public areas with other users (e.g., in a classroom discussion forum authorized by an educator), such information may be viewed by all users in that specific context. We advise caution when sharing personal information in public areas. For students, sharing capabilities are controlled by the Educational Institution or parent/guardian.
  • With Your consent: We may disclose Your personal information for any other purpose with Your explicit consent, or the consent of an Educational Institution or parent/guardian where required.

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy and in accordance with Our agreements with Educational Institutions. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

For Student Data, We retain data only for the period necessary to fulfill the purpose for which it was collected or as required by contract with the Educational Institution, after which it will be securely deleted or anonymized in accordance with our agreements and applicable laws.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.

By using the Service and providing Your information, You consent to such transfer. For users located outside the United States, We will ensure that appropriate safeguards are in place for any international data transfers, such as standard contractual clauses or other legally recognized mechanisms, particularly for Student Data.

The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

Your Rights and Deleting Your Personal Data

You have rights regarding Your Personal Data. For users of CuraCourse, these rights may vary depending on Your role and applicable laws (e.g., FERPA, GDPR, CCPA).

For Individual Users (e.g., educators, parents, independent learners):

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You. Our Service may give You the ability to delete certain information about You from within the Service.

You may update, amend, or delete Your information at any time by signing in to Your Account, if you have one, and visiting the account settings section that allows you to manage Your personal information. You may also contact Us to request access to, correct, or delete any personal information that You have provided to Us.

Please note, however, that We may need to retain certain information when we have a legal obligation or lawful basis to do so.

For Student Data (Managed by Educational Institutions):

For Student Data provided by an Educational Institution, the institution is the primary point of contact for exercising rights under FERPA, COPPA, or other applicable laws. Parents/eligible students who wish to access, amend, or delete student education records should contact their Educational Institution directly. We will cooperate with and assist Educational Institutions in fulfilling these requests in accordance with our agreements and applicable law.

Upon termination of our contract with an Educational Institution, We will securely delete or return all Student Data, subject to any legal obligations to retain certain records.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide prominent notice via email and/or a prominent notice on Our Service before Your Personal Data is transferred and becomes subject to a different Privacy Policy. For Student Data, any such transfer will be subject to strict contractual obligations to ensure continued privacy protection.

Law enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court order, subpoena, or a government agency).

Other legal requirements

The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation (e.g., FERPA, COPPA, GDPR, CCPA).
  • Protect and defend the rights or property of the Company.
  • Prevent or investigate possible wrongdoing in connection with the Service.
  • Protect the personal safety of Users of the Service or the public.
  • Protect against legal liability.

Security of Your Personal Data

The security of Your Personal Data is of utmost importance to Us. We implement robust technical and organizational measures designed to protect Personal Data against unauthorized access, disclosure, alteration, and destruction. These measures include, but are not limited to, encryption in transit and at rest, access controls, regular security audits, and employee training on data privacy and security best practices.

While We strive to use commercially acceptable means to protect Your Personal Data, remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. Therefore, We cannot guarantee its absolute security. We encourage You to take steps to protect your personal information, such as choosing strong passwords and not sharing your account details.

Children's Privacy (COPPA and GDPR-K Compliance)

CuraCourse is designed for use in educational settings, which may include students of all ages. We take Children's privacy very seriously and adhere to applicable laws and regulations, including the Children's Online Privacy Protection Act (COPPA) in the United States, and the provisions of the General Data Protection Regulation (GDPR) concerning children ("GDPR-K") in the European Union.

  • Direct Collection from Children: We do not knowingly collect Personal Data directly from Children under the age of 13 for our own marketing purposes. If We need to collect Personal Data from a Child, it will primarily be collected through an Educational Institution acting on behalf of parents, or with verifiable parental consent.
  • Educational Institutions as Consent Providers: When CuraCourse is used in a school setting, the Educational Institution often provides consent for the collection of Personal Data from students under 13, acting as the verifiable parental consent provider under COPPA, or as the legal basis provider under GDPR, where applicable. Our contracts with schools ensure they obtain any necessary parental consent.
  • Parental Rights: Parents and legal guardians have rights concerning their Children's data. If You are a parent or guardian and You believe Your child has provided Us with Personal Data without proper consent, please contact their Educational Institution first. You may also contact Us directly, and We will work with the relevant Educational Institution to address Your concerns and, if necessary, take steps to remove that information from Our servers.
  • Data Minimization: We only collect the minimum amount of Student Data necessary to provide the educational Service and do not retain it longer than required by our agreements with schools or legal obligations.

Links to Other Websites

Our Service may contain links to other websites that are not operated by Us. If You click on a third party link, You will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services. When linking out from CuraCourse, especially for students, we endeavor to link to educational and appropriate resources, but parental/educator discretion is always advised.

Changes to this Privacy Policy

We may update Our Privacy Policy from time to time to reflect changes in Our practices, technology, legal requirements, or other factors. We will notify You of any material changes by posting the new Privacy Policy on this page.

We will let You know via email (to account holders and Educational Institution administrators) and/or a prominent notice on Our Service, prior to the change becoming effective and update the "Last updated" date at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
